The Texas v. New Mexico Proposed Settlement 

Nat Chakeres & John Longworth, OSE

ABSTRACT

Since 2013, Texas, New Mexico, and the United States have been in litigation before the Supreme Court fighting over the apportionment of surface and groundwater in the lower Rio Grande. The states of Texas and New Mexico have proposed a consent decree that would resolve the issues between the states, but the United States is resisting the consent decree. This presentation will provide a brief overview of the issues in the litigation, the proposed consent decree, and how New Mexico plans to comply the consent decree.

SPEAKER BIOGRAPY:

Nat Chakeres currently serves as the general counsel to the New Mexico State Engineer. He has been with the Office of the State Engineer/Interstate Stream Commission since 2018. He is a graduate of Harvard University and UNM School of Law.  He was an Honors Attorney with the Environment and Natural Resources Division of the United States Department of Justice, where he handled complex environmental litigation. He has also worked in private practice.

John Longworth currently serves as the Senior Advisor to the State Engineer and Interstate Stream Commission Director. He served as the Director of the Interstate Stream Commission from 2017 through 2019 and was the Deputy State Engineer. He has more than 25 years of water resource management and supervisory experience and has held numerous positions within the NM Office of the State Engineer including the Director for the Water Resources Allocation Program Technical Division; Chief of the Water Use and Conservation Bureau; and as a Senior Staff engineer in the Interstate Stream Commission. Mr. Longworth earned an MS degree in environmental engineering from New Mexico State University and a BS degree in civil engineering from the State University of New York at Buffalo. He is a licensed professional engineer in NM.

REGISTRATION:

Membership in AWWA or WEF is not required. All attendees must pre-register for this webinar by Tuesday evening, 7/18/23 at 5:00 p.m. This is required to maintain a record of those attending to satisfy training requirements for PE licensure or Water/Wastewater Operator Certification. Operators will be asked for NM Operator Certification number on the online registration form. Continuing Education is only available in New Mexico.
